Biogem respects your privacy. Whether you are about to purchase a Biogem product or just browsing one of Biogem's websites, Biogem wants you to feel informed about our data protection policies and the security measures we take to protect your personally identifiable information.

For this reason, Biogem has implemented a set of rules that establish a general standard for data protection requirements that all Biogem entities must comply with. This set of rules forms the basis for Biogem's handling of personally identifiable information.

If you provide personal data to Biogem, or we collect personal data about you from other sources, Biogem will process the data in accordance with this policy, which also includes the key content of Biogem's rules.

 

1. General principles for the processing of personal data

Biogem has implemented the following principles for processing to ensure that your personal data is processed correctly and with an appropriate level of data protection:

• Personal data is processed in accordance with the law and in a fair and transparent manner;
• Personal data is collected only for specified, explicitly defined, and legitimate purposes and is not further processed in a manner that is incompatible with those purposes.
• Personal data must be adequate, relevant, and limited to what is necessary for the purposes for which the data is processed.
• Personal data must be accurate, kept up to date as necessary, and inaccurate or incomplete personal data must be rectified or deleted, or further processing must cease.
• Personal data is not kept in a form that allows identification of the data subjects for longer than is necessary for the purposes for which the data was collected or for which it is further processed.
• Personal data must be processed in a manner that ensures an appropriate level of security for the personal data.

 

2. Types of personal data

We collect and process your personal data in several different ways when you contact us through the various existing channels.

It is necessary to process some personal data for us to provide the services you have requested, while other personal data you may choose to provide voluntarily.

The personal data we collect and process can generally be divided into the following categories:

• Contact information such as name, address, phone number, email address, title, workplace, etc.
• Information you provide to us when you contact us via online contact forms, emails, or phone
• Profile information if you create a profile or account with us, including username and password
• User information such as technical data regarding usage and viewing, including
• Internet service provider name
• Information about the website you are visiting us from, and information about pages on our website that you visit, such as the time and date of your visit
• Web browser and operating system used
• IP addresses, in connection with your visits to our websites or your use of our applications, including also on third-party websites
• Requested files and transferred data volume
• Transaction information, including credit card information, when you purchase goods or services from us
• Information from smart meters and measurement of consumption of heating, cooling, and water as well as other types of utilities
• Application information, including your CV, if you apply for a job at Biogem. You will receive separate information regarding the processing of personal data in that regard when you submit your application.

 

As a general rule, we do not process any special categories of personal data (sensitive personal data) about you unless you have given your explicit consent for it, or we are required to do so to comply with applicable law.

 

3. Our purpose for processing your personal data and the legal basis

We only process your personal data to achieve a legitimate purpose, and we generally only process your personal data if:

• You have given your consent to such processing; or
• The processing is necessary to fulfill a contractual obligation; or
• The processing is necessary to comply with legal requirements to which we may be subject; or
• The processing is necessary for our own or third parties' legitimate interests, and such processing is not considered harmful to you.

We process your personal data for the following purposes:

• To provide products, services, and information to you that you have requested; or
• To send you newsletters or other marketing materials, including surveys; or
• To manage our business relationships and negotiate or execute agreements; or
• To manage participation in courses or webinars, or
• To provide general customer service and support; or
• To gain customer insights and knowledge about how our various services, including websites and applications, and products are used and to evaluate and improve them; or
• To communicate with you on various topics; or
• To process trial and product inquiries
• To comply with applicable law.

 

4. Cookies

We may use cookies on our websites or in our applications. You can read more about the use of cookies in our cookie policy, which you will find in the footer of each website.

The purposes of processing data collected through the use of cookies are as follows:

• To operate, improve, and optimize the performance and user experience on the website and its services,
• To conduct customer and user analysis and segmentation to improve our understanding of our users and provide better and tailored services to users, including you,
• Statistical purposes.

 

5. Use of your personal data at Biogem

Biogem is a Northern European organization with offices in several countries. As a general rule, the data controller in connection with the personal data processed about you is the local Biogem entity that you are a customer of, that you contact, or with which you enter into an agreement. However, we may share your personal data with other entities within Biogem for the purposes outlined above in section 3, either to carry out a task according to the data controller's instructions (the recipient acts as a data processor) or for that entity's own legitimate purposes (the recipient acts as an individual data controller), provided that such availability or disclosure of your personal data is not prohibited by law.

 

6. Disclosure, transfer, and availability of personal information to recipients

Our disclosure and transfer of your personal information to recipients (natural or legal persons, public authorities, agencies, or other entities to whom the personal data is disclosed) is limited to a minimum and requires that an appropriate degree of data protection is maintained.

We may disclose or make personal data available to recipients under the following circumstances:

• Recipients who provide services on our behalf, including e.g. hosting, cloud computing, IT support, marketing services, administrative services, educational services, or other data processing. Such recipients are only permitted to process personal data in accordance with our instructions, and the relationship is governed by a written data processing agreement;
• For the purpose of establishing, enforcing, or defending our legal rights; or
• If you have given prior consent to the disclosure of personal data to a recipient or
• In the event of any mergers, sales, joint ventures, assignments, transfers, or other dispositions of all or parts of Biogem's assets or shares (which without limitation includes proceedings related to bankruptcies or similar processes) or
• In accordance with our cookie policy, cf. section 4 above.

If the recipient of the personal data is located in a country outside the EU/EEA that does not ensure an adequate level of data protection, we will only transfer your personal data to such a recipient after executing a written transfer agreement based on the EU Commission's standard contractual clauses.

 

7. Automated individual decision-making

We may use automated decision-making based on your personal data. Automated decision-making only occurs if the decision is:

• Necessary for entering into or performing a contract between you and Biogem;
• Authorized in Union or Member State law to which Biogem is subject, and which also establishes appropriate safeguards for the protection of your rights, freedoms, and legitimate interests; or
• Based on your consent.

In cases where we use automated decision-making, we ensure that appropriate safeguards are implemented.

Special personal data will under no circumstances be subject to automated decision-making unless you have given your explicit consent, or the processing is necessary for reasons of substantial public interest based on applicable law.

 

8. Your consent

As indicated above, certain of our processing activities will be based on your consent. In such cases, you have the right to withdraw your consent at any time.

 

If you withdraw your consent, we will cease processing your personal data, unless and to the extent that further processing or retention is permitted or required under applicable data protection legislation or other applicable laws and regulations.

 

Please note that the withdrawal of your consent does not affect the lawfulness of the processing that has occurred prior to the withdrawal. Furthermore, as a consequence of your withdrawal of consent, we may not be able to meet your requests or provide our services to you.

You can, among other things, give your consent to Biogem to subscribe to receive marketing information about new, relevant, and upcoming Biogem products, solutions, and services, as well as newsletters about e.g. fairs and presentations.

 

9. Data retention

We retain your personal data for as long as necessary to fulfill the underlying purpose, but at least for the applicable legal retention period.
As soon as the underlying purpose or legal basis has ceased, personal data will be deleted.

 

10. Data security

Biogem has implemented appropriate technical and organizational measures to protect your personal data, which must ensure a level of security appropriate to the risk posed by the processing and the nature of the personal data to be protected, taking into account the current technological development and the costs of implementing such measures.
After assessing the risk, Biogem has taken measures to protect personal data against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure, or access, especially where the processing involves the transmission of personal data in a network, and against all other forms of unlawful processing.

  

11. Internal audits

Biogem conducts regular audits of the ongoing processing of personal data to ensure that all Biogem entities comply with Biogem's rules and process personal data accordingly.

These audits cover all aspects of Biogem's rules and include all IT systems, databases, security policies/standards, training programs, personal data policies, and manuals used in Biogem.

 

12. Your rights

You have the right to access the data processed about you, which is subject to certain legal exceptions. You may also object to the collection and further processing of your personal data. Additionally, you have the right to correct your personal data if necessary. You can also choose to request that we restrict the processing.

We will delete or correct any information that may be erroneous or outdated due to the time elapsed since its collection or due to other information we may possess.

If you send us a written request, we will also delete your personal data without undue delay unless we have a legal basis to continue processing, e.g., if the processing is necessary to establish, enforce, or defend legal claims or necessary to perform a contractual relationship with you.

In connection with such requests, please ensure that we have relevant information so that we can meet your request, including your full name and your email address so we can identify you. We will respond to your inquiry as soon as possible and within a month.

If you do not agree with our processing of your personal data, please be aware that you can file a complaint with your local data protection authorities.

We will review and evaluate your complaint, and we will contact you if necessary to obtain additional information.

 

We strive to handle complaints and objections within a month. If it is not possible to make a decision within a month, we will inform you of the reason for the delay and the time (no more than two months from receipt) when the decision can be expected to be made.

 

You can at any time before, during, or after the complaint process described above, also complain/file a case with your local data protection authorities or other authorities in the same jurisdiction as the relevant local Biogem entity or Biogem A/S.

14. Links to other websites, etc.

Our websites may contain links to other websites or to integrated websites. We are not responsible for the content of websites belonging to other companies (third-party websites) or for such companies' practices regarding the collection of personal data. When you visit third-party websites, you should read the owner's policy regarding the protection of personal data as well as other relevant regulations.

15. Changes to this privacy policy

We reserve the right to change this privacy policy in the future due to changes in applicable law, in Biogem's rules, or in Biogem's processes. We will inform you of such changes.
